Welcome to Five Year Journal (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website and services, including writing journal entries, attaching images, following other users, and any other features we offer. By accessing or using our website, you agree to these Terms. If you do not agree, please do not use our services.
1. Eligibility
You must be at least 13 years old to use our services. By using the website, you represent that you meet this requirement and have the capacity to agree to these Terms.
2. Account Registration
- You must create an account to access our services fully.
- You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
- Notify us immediately of any unauthorized use of your account.
3. User Content
- You retain ownership of any content, including journal entries and images, you upload to the website (“User Content”).
- By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to store, display, and process your content for the purpose of providing our services.
- You are solely responsible for the content you upload and agree not to upload any:
- Illegal, harmful, or abusive material.
- Content that violates third-party intellectual property rights.
- Obscene or inappropriate material.
4. Sharing and Visibility
Each journal entry has a visibility setting that you control:
- Private: visible only to you.
- Mutuals: visible to people you follow who also follow you back.
- Public: visible to anyone who follows you.
When you mark an entry as “mutuals” or “public,” you are choosing to share that content with other users, and you are responsible for what you choose to share. Sharing entries with other users is a premium feature (see below).
5. Subscriptions and Payments
- Some features (such as back-dating entries, attaching images, using all look-back intervals, and sharing entries with mutuals or the public) require a paid Premium subscription. Other features remain available for free.
- Premium is offered on a recurring basis (for example, monthly or yearly). The current prices are shown on our pricing page.
- Payment processing: Payments are processed by Stripe. By subscribing, you also agree to Stripe’s terms. We do not collect or store your full payment card details.
- Automatic renewal: Subscriptions renew automatically at the end of each billing period, and your payment method is charged for the next period, until you cancel.
- Free trial: We may offer a free trial (currently 7 days) once per account. A payment method is required to start a trial. If you do not cancel before the trial ends, your subscription will begin and your payment method will be charged.
- Cancellation: You may cancel at any time through the billing portal linked from your settings page. Cancellation stops future renewals; your premium access continues until the end of the current billing period.
- Refunds: Payments are non-refundable, except where required by law. Cancelling does not entitle you to a refund for the current billing period.
- Price changes: We may change our prices. Any change will apply to billing periods that begin after we notify you.
- If a payment fails or your subscription lapses, premium features may be disabled, but your account and journal entries remain intact.
6. Privacy
Your use of the website is subject to our Privacy Policy, which explains how we collect, use, and protect your data.
7. Prohibited Activities
You agree not to:
- Use the website for unlawful purposes.
- Attempt to hack, disrupt, or overload the website’s infrastructure.
- Share or distribute harmful software or files.
- Impersonate another individual or entity.
8. Termination
We reserve the right to suspend or terminate your account without notice if you violate these Terms or engage in harmful or prohibited activities. If we terminate your account for a violation of these Terms, you are not entitled to a refund of any fees already paid.
9. Intellectual Property
The website and its content, including text, graphics, and features (excluding User Content), are owned by us or our licensors. You may not copy, modify, or distribute any of this material without our prior written consent.
10. Limitation of Liability
We are not liable for any damages resulting from:
- Your use or inability to use the website.
- Unauthorized access to your account or content.
- Errors, interruptions, or loss of data.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, liabilities, damages, or expenses arising from your use of the website or your breach of these Terms.
12. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the website. Your continued use of the website after changes are posted constitutes your acceptance of the new Terms.
13. Governing Law
These Terms are governed by the laws of the United States of America, without regard to its conflict of law principles.
